Turkish Competition Board Concluded Preliminary Inquiry Into Apple Over Alleged Article 4 Violation For Fixing Reseller Sale Prices

The Competition Board (Board) concluded the preliminary inquiry conducted into the allegation that Apple Teknoloji ve Satış Limited Şirketi (APPLE), which is engaged in sale and distribution activities in Türkiye, including imports and exports of technologic devices such as computers, tablets, mobile phones, earphones, peripheral equipment and Apple or third-party brand accessories, violated Article 4 of the Act no 4054 on the Protection of Competition (Act no 4054) by intervening with the sale prices of resellers.

In line with the observations made during the on-site inspections conducted within the framework of the preliminary inquiry, the decision no 25-08/184-M(1) was taken in the Board meeting of 27.02.2025 to launch an investigation under Article 41 of the Act no 4054 on

  • Destek Bilişim Proje ve Servis Hizmetleri Sanayi Dış Ticaret Anonim Şirketi,
  • Easycep Bilişim ve Ticaret AŞ,
  • Getmobil Teknoloji AŞ, and
  • HB Bilişim Teknolojileri Sanayi Tic. AŞ

to determine whether 4 of the Act no 4054 was violated by means of APPLE fixing the resale prices and/or campaign conditions of Apple brand products and coordinating the buyback prices for Apple brand products offered by undertakings in the buyback market through the aforementioned undertakings.
